a) The Customary Laws

The customary laws were the first laws which Somali society used before the formation of constitutional law thus, our future government will have to abide by all forms of our traditional norms and customary laws.
Our customary laws are also based on traditional and religious values which majority of our people believe and trust.

b) Civil Courts

The civil courts are operated by professional judges and lawyers, and they are appointed by the President of the Democratic Republic of Somalia for once and to  serve for lifetime until retirement or death.

The Judges are proposed by the national parliamentary judicial committee then the President approves him/her to take up key judicial posts in the county.
The civil courts will be the best option to carry out better justice for all, and will be the primary source for national and constitutional law.

  • To be a civil  judge, you mus have 10 years experience or PhD in Law for 5 years.
  • To be a civil lawyer, you must have a Bachelor of Laws plus 3 years experience in Somalia.

c) Military Court (Marshal Law)

The marshal court is the only military court which implements marshal law when and where there is a need for interdisciplinary charges of any forces crimes in Somalia. a
